1. Scope and Acceptance

These General Terms and Conditions ("T&Cs") govern the contractual relationship between Siren Tattoo ("Evelyn Kalt", "the Artist", "we", "us") and any person ("the Client", "you") who submits a booking enquiry, places a deposit, or receives tattooing or illustration services from Siren Tattoo, whether in person at our studio in Lucerne, Switzerland, or initiated via this website.

By submitting a booking enquiry or paying a deposit, the Client confirms they have read, understood, and accepted these T&Cs in full. These T&Cs apply to all services offered by Siren Tattoo unless otherwise agreed in writing.

Deviating or supplementary conditions of the Client are not recognised unless explicitly confirmed in writing by Siren Tattoo.

2. Services Offered

Siren Tattoo provides the following services:

  • Custom tattoos— original designs created specifically for the Client based on an agreed brief. 

  • Flash tattoos — pre-drawn designs available from our collections, offered on a first-come, first-served basis. 

  • Cover-up and touch-up work — modification or enhancement of existing tattoos, subject to individual assessment

  • Tattoo consultation and illustration — design advice and preparatory artwork

Appointments receive priority, but walk-ins are also welcome. The Artist reserves the right to decline any project that falls outside their artistic style or that conflicts with their professional or ethical standards.

3. Booking Process

3.1 Enquiry

A booking begins with the submission of a completed enquiry form via this website. Submitting an enquiry does not constitute a binding booking. The Artist will respond within 3–5 business days. If the project is accepted, a deposit needs to be paid before the booking is confirmed.

3.2 Confirmation and Deposit

A booking is only confirmed once the required deposit has been received in full. Until payment of the deposit, no date is reserved.

3.3 Age Requirement

⚠ Tattooing of persons under 18 years of age is strictly prohibited under Swiss law (Art. 11 ZGB; cantonal health legislation). Valid photo ID will be required at the appointment. Any booking found to involve a minor will be immediately cancelled with forfeiture of the deposit.

4. Deposit Policy

4.1 Amount

In order to confirm and reserve an appointment, a deposit is usually required. This typically ranges from a quarter to half of the estimated tattoo price and is paid in advance. The exact amount will be stated after the consultation and before the tattooing takes place.

4.2 Purpose

The deposit covers the Artist's time spent on design preparation, consultation, and scheduling. It is deducted from the total price of the tattoo session on the day of the appointment.

4.3 Non-Refundable Nature

The deposit is non-refundable in all circumstances, including if the Client:

  • Fails to attend without prior notice (no-show)

  • Late arrival that results in cancellation

  • Cancels with less than 48 hours' notice

  • Provides false information at booking (e.g. age, health conditions)

  • Arrives in a condition that prevents tattooing (e.g. intoxicated, sunburned, active skin infection)

  • The non-refundable nature of the deposit is consistent with Swiss law (Art. 158 CO: earnest money / Reugeld).

4.4 Transferability

With at least 48 hours' notice, the deposit may be transferred once to a rescheduled date. Further rescheduling forfeits the deposit, and a new deposit will be required. 

5. Pricing and Payment

5.1 Quotes

Price estimates provided at consultation are indicative only. The final price is determined by actual time and complexity. Multi-session projects will be charged per session.

5.2 Payment

The remaining balance is due in full on the day of the appointment. Accepted payment methods: cash (CHF) or TWINT.

5.3 All prices are in Swiss Francs (CHF) and include applicable VAT where required by law.

6. Client Obligations

The Client agrees to:

  • Arrive on time. Arriving more than  30 minutes late without notice may result in cancellation with forfeiture of the deposit

  • Arrive sober and in good health. Appointments will be declined for clients under the influence of alcohol or drugs

  • Present a valid photo ID (passport, Swiss ID, or equivalent) on request

  • Disclose any known health conditions, allergies, or medications relevant to tattooing

  • Eat a full meal before the appointment and stay well-hydrated

  • Do not apply numbing cream or topical products to the area without prior written agreement

  • Treat the Artist and studio with respect. Harassment or threatening behaviour will result in immediate termination without refund 

7. Health, Safety and Contraindications

The Artist reserves the right to refuse or postpone a session if proceeding would pose a health or safety risk. The following conditions may prevent tattooing:

  • Pregnancy or breastfeeding

  • Active skin infection, eczema, psoriasis, or open wounds at the placement area

  • Recent sunburn in the placement area

  • Use of blood-thinning medication — please consult your doctor

  • Known allergy to tattoo ink pigments

  • Compromised immune system or autoimmune conditions

If a session cannot proceed due to an undisclosed health concern, the deposit will be forfeited. Siren Tattoo accepts no liability for complications arising from undisclosed health conditions. 

8. Design Rights and Intellectual Property

8.1 Copyright

All designs, sketches, flash artwork, and illustrations created by Siren Tattoo are protected by Swiss copyright law (URG, SR 231.1). The Artist retains full intellectual property rights over all original designs. 

8.2 Licence to the Client

Upon full payment, the Client receives a personal, non-exclusive, non-transferable licence to wear the tattoo on their body. This does not include the right to reproduce, sell, or use the design for commercial purposes without express written consent. 

8.3 Flash Designs

Flash designs listed on this website are retired upon booking — each design is tattooed only once. Direct copies of another artist's work will be declined. 

8.4 Portfolio Use

The Artist reserves the right to photograph finished work and publish images for portfolio and promotional purposes. If you prefer your tattoo not to be published, please notify us in writing before your appointment.

9. Aftercare

9.1 Aftercare Instructions

Full written aftercare instructions will be provided at the end of your session and sent by email upon request. The Client is responsible for following these instructions.

9.2 Healing

Tattoo healing varies between individuals. Siren Tattoo cannot guarantee identical healed results for all clients and accepts no liability for variations resulting from individual healing or failure to follow aftercare instructions. 

10. Limitation of Liability

Siren Tattoo performs all services with professional care. Liability is limited to the extent permitted by Swiss law (Art. 100 CO):

  • No liability for allergic reactions to standard ink ingredients where no allergy was disclosed at booking

  • No liability for complications or damages resulting from improper handling, lack of care, or failure to follow aftercare instructions.

  • No liability for indirect or consequential loss (e.g. time off work during healing) 

Nothing in these T&Cs excludes or limits liability for personal injury or damage to health caused by the Artist's gross negligence or intentional acts. 

11. Cancellation by the Artist

In exceptional circumstances (illness, emergency, force majeure), Siren Tattoo may cancel or postpone an appointment. In such cases, the Client will be notified as soon as possible, a replacement date will be offered, and if no suitable date can be agreed upon within 60 days, the deposit will be refunded in full. This is the only circumstance in which the deposit is refundable. 

12. Governing Law and Jurisdiction

These T&Cs are governed exclusively by  Swiss law, in particular the Swiss Code of Obligations (OR/CO, SR 220). The application of the CISG is excluded.

The exclusive place of jurisdiction for any disputes is  Lucerne, Switzerland, subject to mandatory provisions of Swiss consumer protection law (Art. 32 ZPO). 

13. Dispute Resolution

In the event of a dispute, we encourage Clients to contact us directly so that we may seek an amicable resolution. If no resolution can be reached, the Client may contact the cantonal consumer arbitration board or initiate proceedings before the competent court in Lucerne.

14. Severability and Amendments

Should any provision be or become invalid, the remaining provisions shall remain in full force. The invalid provision shall be replaced by a valid provision that most closely reflects the original intent (Art. 20 CO).

Siren Tattoo reserves the right to amend these T&Cs at any time. The version published at the time of booking applies.
